DIVORCE

LITIGATION

Litigation is the more traditional way of divorcing.  Some divorces can't be resolved though mediation, negotiations or collaborative efforts, examples include uncontested divorces, situations involving domestic violence, unreasonable or unrealistic spouses, and cases where your spouse is hiding assets.  Some cases can also start out in litigation but can move into mediation after issues are narrowed and discovery is completed.

COLLABORATIVE

DIVORCE

Collaborative divorce is a process of divorcing which starts before any court cases are filed.  The process involves a series of meetings between both spouses and their "team."  The "team" consists of each spouse's attorney and may include a financial planner, a child specialist and other key professionals. This team meets together in order to negotiate and craft a divorce agreement that works for the family's unique situation.  Often times this method of divorce works well to preserve family relationships.

MEDIATION

Mediation is a controlled and non-confrontational process that allows people involved in a family law dispute to talk about their issues in a structured, productive and safe environment.  Based upon these discussions, parties work to form an agreement that fits their family's needs.  Mediation is also used to negotiate changes to existing parenting agreements.  Mediation can, but doesn't have to include attorneys as part of the mediation sessions.  Mediation can take place at any phase of the process.
